Please read these terms carefully. By downloading, installing, or using PhotoLens, you agree to be bound by them in their entirety.

PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY BEFORE DOWNLOADING, INSTALLING, OR USING THE PHOTOLENS APPLICATION. BY ACCESSING OR USING THE APPLICATION, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE LEGALLY BOUND BY THESE TERMS AND CONDITIONS IN THEIR ENTIRETY. IF YOU DO NOT AGREE TO THESE TERMS, YOU MUST NOT DOWNLOAD, INSTALL, OR USE THE APPLICATION.
1. Definitions
For the purposes of these Terms and Conditions, the following terms shall have the meanings ascribed to them below. These definitions apply uniformly throughout this document, whether the defined terms appear in the singular or plural form.
"Application" or "App" means the PhotoLens mobile application, including all of its features, functionality, user interface elements, content, and any updates, upgrades, patches, or supplemental versions thereof, developed and published by the Developer for Android devices.
"Developer" means Susant Swain, an individual developer and the sole creator, maintainer, and operator of the PhotoLens Application, reachable at info@susantswain.com.
"User" or "You" means any individual who downloads, installs, accesses, or otherwise uses the Application, whether or not such individual has explicitly agreed to these Terms through a registration process.
"Terms" or "Terms and Conditions" means this legal agreement in its entirety, including all schedules, annexures, and documents incorporated herein by reference, as may be amended from time to time in accordance with Section 20.
"Device" means the Android smartphone, tablet, or other compatible mobile hardware on which the User installs and operates the Application.
"On-Device Processing" means the method by which the Application performs all computation, analysis, and inference operations exclusively on the User's Device, without transmitting any data to remote servers, cloud infrastructure, or third-party endpoints.
"AI Model" or "Gemma 4 Model" means the Google Gemma 4 open-weight artificial intelligence language and vision model, including the E2B and E4B variants, as integrated into the Application and executed locally on the User's Device via the LiteRT-LM inference framework (formerly MediaPipe LLM Inference).
"LiteRT-LM" or "Inference Framework" means the on-device machine learning inference runtime, formerly known as MediaPipe LLM Inference, developed and maintained by Google LLC, which is used by the Application to execute the AI Model on the User's Device hardware.
"User Content" means all photographs, images, metadata associated with photographs, and any other files stored on the User's Device that the Application accesses, processes, or analyzes, solely for the purpose of providing the described functionality of the Application.
"AI-Generated Description" means any textual output produced by the Application's AI processing pipeline as a result of analyzing a photograph, including any chain-of-thought reasoning, categorical classifications, quality assessments, or natural language descriptions of image content.
"Accessibility Features" means the set of design and technical capabilities within the Application intended to support users with visual impairments, blindness, or low vision, including but not limited to compatibility with the Android TalkBack screen reader, meaningful semantic content labeling, keyboard-navigable controls, high-contrast display elements, and compliance with relevant accessibility guidelines.
"Third-Party Components" means any open-source libraries, frameworks, SDKs, runtimes, or other software components developed by parties other than the Developer that are incorporated into the Application, including but not limited to the LiteRT-LM framework and the Gemma 4 model weights.
"Intellectual Property Rights" means all patents, copyrights, trademarks, trade secrets, design rights, moral rights, database rights, and all other proprietary rights of whatever nature, whether registered or unregistered, existing anywhere in the world.
"Effective Date" means May 8, 2026, the date from which these Terms come into legal force and effect.
"Google" means Google LLC, a Delaware limited liability company, and its affiliates, subsidiaries, and successors, the developer and licensor of the Gemma 4 model and the LiteRT-LM inference framework.
"Force Majeure Event" means any event beyond the reasonable control of the Developer, including but not limited to natural disasters, acts of government, war, terrorism, pandemic, infrastructure failure, or any action or inaction of a third-party platform or service provider.
"Feedback" means any suggestions, ideas, bug reports, feature requests, comments, or other communications that a User voluntarily submits to the Developer regarding the Application.
"Sensitive Personal Information" means photographs, images, or visual content that may depict family members, minors, private residences, medical conditions, personal documents, financial records, or other content of an inherently private, sensitive, or confidential nature.
2. Acceptance of Terms
2.1 Agreement by Use
By downloading, installing, or using the PhotoLens Application in any manner, you enter into a legally binding agreement with the Developer and confirm your unconditional acceptance of these Terms and Conditions. Your continued use of the Application at any time constitutes your ongoing acceptance of the then-current version of these Terms.
2.2 Affirmative Agreement
If you are accessing the Application through the Google Play Store or any other authorized distribution channel, your act of clicking "Accept," "Install," "Download," or any equivalent action shall constitute your express acceptance of these Terms to the fullest extent permitted by applicable law.
2.3 Authority to Accept
If you are accepting these Terms on behalf of an organization, legal entity, or another individual, you represent and warrant that you have the full legal authority to bind that organization, entity, or individual to these Terms. If you lack such authority, you must not use the Application.
2.4 Age Representation
By accepting these Terms, you represent that you are at least 13 years of age. If you are under the age of 18, you represent that a parent or legal guardian has reviewed and consented to these Terms on your behalf.
3. Eligibility and Account Requirements
3.1 No Account Required
PhotoLens does not require the creation of a user account, registration, or the provision of any personal information to access or use its core functionality. The Application is designed to function entirely without a login, sign-up process, or any form of user identification.
3.2 Device Ownership or Authorization
You represent and warrant that the Device on which you install and use the Application is either owned by you or that you have the express permission of the Device owner to install and use third-party applications. You further warrant that you are permitted to grant the Application access to the photographs and files on that Device.
3.3 Compliance with Platform Terms
Your installation and use of the Application must comply with the terms and conditions of the platform or marketplace through which you obtained it, including but not limited to the Google Play Developer Distribution Agreement. These Terms are supplemental to, and do not supersede, your obligations under the applicable platform terms.
3.4 Geographic Availability
The Application may not be available in all geographic regions. The Developer makes no representation that the Application is appropriate or available for use in all locations. Users are solely responsible for compliance with local laws applicable to their use of the Application.
4. Description of the Application and Services
4.1 Core Purpose
PhotoLens is a mobile gallery application designed primarily for individuals who are blind or have low vision, as well as for any user who wishes to understand the content of their photographs through natural language descriptions. The Application enables users to navigate their photo gallery, access photographs, and receive automatically generated textual descriptions of image content.
4.2 Key Features
The Application provides, among other things, the following features:
- Automatic Photo Description: The Application can automatically analyze photographs and generate natural language descriptions explaining the subjects, composition, mood, and technical qualities of the image.
- Manual Description Generation: Users may manually trigger the description of any selected photograph at any time by activating the dedicated "Generate Description" button.
- Auto-Generation Mode: When enabled in the Application settings, descriptions will be generated automatically as the user browses through their gallery.
- Regeneration Capability: Users may request alternative or additional descriptions of the same photograph using the "Regenerate" function.
- Thinking Mode: The Application may expose the AI Model's chain-of-thought reasoning process, providing users with greater transparency into how a description was derived.
- Agentic Analysis: Using structured function calling, the AI Model can extract technical image quality metrics, emotional tone, and categorical classifications from a single photograph in one processing pass.
- TalkBack Compatibility: The Application is designed to be fully compatible with the Android TalkBack screen reader, ensuring that all UI elements are properly labeled and navigable by users who rely on screen readers.
- High-Contrast and Accessible Design: The Application implements high-contrast visual design, predictable navigation patterns, and compliance with WCAG accessibility guidelines to support users with a range of visual and motor impairments.
4.3 Nature of the Service
The Developer provides the Application as a utility tool and does not guarantee any specific outcome, result, level of accuracy, or quality of AI-Generated Descriptions. The descriptions produced are for informational and assistive purposes only.
4.4 No Cloud Service
PhotoLens is not a cloud-based service. It does not require an internet connection for its core AI description functionality. All AI processing occurs entirely on the User's Device. The Application does not collect, transmit, store, or process User Content on any external server.
5. License Grant and Restrictions
5.1 Limited Personal License
Subject to your compliance with these Terms, the Developer grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download, install, and use the Application on a Device that you own or control, solely for your personal, non-commercial purposes.
5.2 Restrictions on Use
You may not, and you agree not to, directly or indirectly:
- Copy, reproduce, modify, adapt, translate, create derivative works of, or distribute the Application or any part thereof;
- Reverse engineer, disassemble, decompile, decode, or otherwise attempt to derive the source code, underlying algorithms, model weights, or architecture of the Application or any of its components, except to the extent expressly permitted by applicable law;
- Remove, alter, or obscure any copyright, trademark, patent, or other proprietary notices or labels affixed to or contained within the Application;
- Rent, lease, lend, sell, sublicense, assign, or otherwise transfer rights to the Application or your license hereunder to any third party;
- Use the Application for any commercial purpose, including but not limited to operating a service bureau, time-sharing arrangement, or application service provider model;
- Use the Application in any way that violates any applicable local, state, national, or international law or regulation;
- Use the Application to process photographs belonging to other individuals without their knowledge and informed consent;
- Attempt to circumvent any technical limitations, security measures, or access controls within the Application;
- Use the Application in any manner that could damage, disable, overburden, or impair the Application or interfere with any other party's use of the Application.
5.3 Reservation of Rights
The Developer reserves all rights not expressly granted to you in these Terms. No license or right is granted by implication, estoppel, or otherwise. These Terms do not transfer any Intellectual Property Rights in or to the Application to you.
6. Privacy and Data Protection
6.1 Privacy-First Architecture
PhotoLens is architecturally designed to preserve the privacy of its users. All photograph processing, AI inference, and description generation occurs entirely on the User's Device. The Application does not include any code, SDK, or module that transmits User Content, metadata associated with photographs, or any personally identifiable information to the Developer or any third party.
6.2 No Data Collection
The Developer does not collect, gather, receive, store, or have access to:
- Any photographs or images from the User's Device;
- Any metadata associated with photographs, including but not limited to GPS location data, timestamps, device identifiers, or EXIF data;
- Any AI-Generated Descriptions produced by the Application;
- Any browsing behavior, usage patterns, interaction logs, or analytics within the Application;
- Any personal identifiers, including name, email address, IP address, or device ID.
6.3 No Third-Party Analytics or Advertising
The Application does not incorporate any third-party analytics frameworks, advertising SDKs, behavioral tracking tools, or crash reporting services that transmit data off the Device.
6.4 Device Permissions
In order to perform its core functionality, the Application requires access to the photograph library or media storage on the User's Device. This permission is used solely to read and display photographs within the Application's gallery interface and to pass image data to the on-device AI Model for processing. The Application does not write, modify, delete, or export any photographs from the User's Device without the User's explicit action.
6.5 User-Initiated Communications
If you contact the Developer by email at info@susantswain.com, via WhatsApp, or via Telegram for support or feedback purposes, any information you voluntarily provide in that communication is subject to the Developer's handling practices for correspondence. The Developer will use such information solely for the purpose of responding to your inquiry and will not share it with third parties except as required by law.
6.6 Sensitive Personal Information
You acknowledge that photographs may contain Sensitive Personal Information. Because the Application processes all content exclusively on your Device and does not transmit any data externally, the Developer has no access to or responsibility for any Sensitive Personal Information contained in photographs you choose to analyze using the Application. You are solely responsible for deciding which photographs to process and for the security of your Device.
6.7 Children's Privacy
The Application is not directed at children under the age of 13, and the Developer does not knowingly collect any information from children under 13. Because the Application does not collect any user data, this risk is inherently mitigated by the Application's architecture.
7. On-Device AI Processing and Gemma 4 Model
7.1 Technology Description
PhotoLens uses the Google Gemma 4 open-weight AI model, specifically the E2B and E4B multimodal variants, executed locally on the User's Device through the LiteRT-LM inference framework. These models are capable of understanding and reasoning about both textual and visual inputs, enabling the Application to produce natural language descriptions of photographs without any internet connectivity.
7.2 Google's Role
The Gemma 4 model and the LiteRT-LM framework are developed, trained, and maintained by Google LLC. The Developer has integrated these technologies into the Application pursuant to the applicable open-weight model license terms published by Google. The Developer is not affiliated with, endorsed by, or acting as an agent of Google LLC. Google is not a party to these Terms.
7.3 Model Behavior and Limitations
Artificial intelligence models, including the Gemma 4 model, are probabilistic systems. They do not operate with certainty and may produce outputs that are:
- Factually inaccurate, incomplete, or misleading;
- Inconsistent across different sessions or regeneration attempts on the same photograph;
- Offensive, biased, or inappropriate in rare and unintended circumstances;
- Inapplicable or unhelpful for certain types of photographs, low-quality images, or images with unusual visual characteristics.
You acknowledge and accept these inherent limitations.
7.4 No Reliance for Critical Decisions
AI-Generated Descriptions produced by the Application must not be used as the sole basis for any safety-critical, medical, legal, financial, or otherwise consequential decision. The descriptions are provided as an assistive and informational tool only.
7.5 Device Hardware Requirements
On-device AI inference is computationally intensive. The Application requires a Device with sufficient GPU or NPU capability to run the Gemma 4 model efficiently. Performance, speed, and availability of AI features may vary significantly depending on the User's Device hardware, available RAM, battery status, and thermal conditions.
7.6 Model Updates
The Developer may, at its discretion, update, replace, or remove the AI Model integrated into the Application in future versions. Such changes may affect the quality, style, or content of AI-Generated Descriptions.
8. User Content and Intellectual Property
8.1 Ownership of User Content
All photographs and images stored on your Device and accessed by the Application remain your property (or the property of their respective rights holders). The Application does not claim any ownership, license, or other rights in or to your photographs by virtue of processing them.
8.2 No Transfer of Rights
By using the Application to generate descriptions of your photographs, you do not transfer any rights in those photographs to the Developer. The Developer has no access to your photographs and cannot use, distribute, or reproduce them in any way.
8.3 Third-Party Photographs
You represent and warrant that you have all necessary rights, permissions, and consents required to process any photograph using the Application. If you use the Application to analyze photographs owned by or depicting other individuals, you are solely responsible for ensuring that you have obtained all required permissions from the relevant rights holders and that your use complies with applicable privacy, data protection, and intellectual property laws.
8.4 AI-Generated Output Ownership
The AI-Generated Descriptions produced by the Application are generated on your Device. The Developer makes no claim of ownership over descriptions generated through your use of the Application. However, the Developer is not responsible for the content of any such descriptions, and you assume all risk associated with any use you make of them.
8.5 Feedback
If you submit Feedback to the Developer, you grant the Developer a perpetual, irrevocable, worldwide, royalty-free, sublicensable license to use, copy, modify, distribute, and incorporate such Feedback into the Application or any other products or services, without any obligation of compensation, attribution, or confidentiality to you.
9. Accessibility Commitment and Limitations
9.1 Developer's Commitment
The Developer is committed to making PhotoLens the most accessible photo gallery application available for users with visual impairments. Accessibility is a core design principle, not an ancillary feature. The Developer actively works to ensure full compatibility with the Android TalkBack screen reader, clear semantic labeling of all interface elements, predictable and simple navigation, and ongoing compliance with WCAG 2.1 Level AA guidelines where feasible.
9.2 Reporting Accessibility Issues
If you encounter any element of the Application that is not properly announced by your screen reader, is difficult to navigate, or does not conform to your accessibility expectations, the Developer strongly encourages you to report the issue by contacting info@susantswain.com or via the WhatsApp contact provided. The Developer will make reasonable efforts to address reported accessibility issues promptly.
9.3 No Guarantee of Perfect Accessibility
While the Developer makes every reasonable effort to ensure the Application meets high accessibility standards, the Developer does not warrant or guarantee that the Application will be perfectly compatible with all versions of TalkBack, all third-party accessibility services, all Device configurations, or all future updates to the Android operating system. Accessibility features may behave differently depending on the User's Device model, operating system version, and individual accessibility settings.
9.4 Assistive Technology Dependencies
The Application's accessibility features operate in conjunction with third-party assistive technologies, including TalkBack, which are developed and maintained by Google. The Developer is not responsible for changes in behavior caused by updates to such third-party technologies.
10. Prohibited Uses and Conduct
10.1 General Prohibitions
You agree that you will not use the Application in any manner that:
- Violates any applicable law, statute, regulation, ordinance, or treaty;
- Infringes upon the Intellectual Property Rights of any third party;
- Violates the privacy, data protection, or other personal rights of any individual;
- Constitutes or facilitates harassment, stalking, surveillance, or unauthorized monitoring of any person;
- Involves the processing of photographs of minors without the explicit consent of a parent or legal guardian, where such processing is for any purpose other than personal family use by the minor's own guardian;
- Facilitates the creation, distribution, or use of deepfake imagery, synthetic media, or any manipulated content intended to deceive or mislead;
- Interferes with or disrupts the integrity, security, or performance of the Application, any associated systems, or any third-party services;
- Involves any attempt to extract, replicate, or repurpose the AI Model weights, inference logic, or output generation pipeline for any commercial or non-personal use;
- Circumvents or disables any security or access control mechanism within the Application;
- Is otherwise fraudulent, deceptive, harmful, or in bad faith.
10.2 Consequences of Violation
Any breach of this Section 10 may result in the immediate termination of your license to use the Application. The Developer reserves all legal rights and remedies available in the event of any such violation, including seeking injunctive relief, damages, and any other equitable or legal remedies permitted by applicable law.
11. Disclaimers and Accuracy of AI-Generated Descriptions
11.1 "As Is" Basis
THE APPLICATION IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE DEVELOPER EXPRESSLY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, NON-INFRINGEMENT, QUIET ENJOYMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.
11.2 No Warranty of Accuracy
The Developer does not warrant that AI-Generated Descriptions will be accurate, complete, reliable, error-free, or suitable for any particular purpose. Descriptions are the probabilistic output of a machine learning model and may contain factual errors, omissions, hallucinations, or unintended language. Users must apply their own judgment when using or acting upon any AI-Generated Description.
11.3 No Warranty of Availability
The Developer does not warrant that the Application will be available at all times, free from bugs, errors, viruses, or other harmful components, or that defects will be corrected. The Application may be temporarily unavailable due to maintenance, updates, or causes beyond the Developer's control.
11.4 No Medical, Legal, or Safety Warranty
Nothing in the Application or these Terms constitutes medical, legal, financial, or safety advice. AI-Generated Descriptions must not be treated as a substitute for professional advice in any field.
11.5 Third-Party Component Disclaimer
The Developer disclaims all warranties with respect to Third-Party Components, including the Gemma 4 model and the LiteRT-LM framework, and makes no representations regarding their accuracy, reliability, fitness, or continued availability.
12. Limitation of Liability
12.1 Exclusion of Indirect Damages
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE DEVELOPER BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, LOSS OF GOODWILL, LOSS OF PRIVACY, DAMAGE TO REPUTATION, PERSONAL INJURY, OR ANY OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR YOUR USE OF OR INABILITY TO USE THE APPLICATION, REGARDLESS OF THE CAUSE OF ACTION OR THE THEORY OF LIABILITY (INCLUDING CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE), EVEN IF THE DEVELOPER HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
12.2 Cap on Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE DEVELOPER'S TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE APPLICATION SHALL NOT EXCEED THE AMOUNT, IF ANY, THAT YOU PAID TO THE DEVELOPER FOR THE APPLICATION IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM. BECAUSE THE APPLICATION IS PROVIDED FREE OF CHARGE, THIS CAP SHALL BE ZERO (0) IN THE ABSENCE OF ANY PAYMENT.
12.3 Essential Basis of the Bargain
YOU ACKNOWLEDGE THAT THE LIMITATIONS OF LIABILITY SET FORTH IN THIS SECTION 12 ARE AN ESSENTIAL ELEMENT OF THE BASIS OF THE BARGAIN BETWEEN YOU AND THE DEVELOPER, AND THAT THE DEVELOPER WOULD NOT HAVE PROVIDED THE APPLICATION WITHOUT THESE LIMITATIONS.
12.4 Jurisdictional Exceptions
Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities. In such jurisdictions, the exclusions and limitations set forth in these Terms shall apply to the maximum extent permitted by applicable law, and the Developer's liability shall be limited to the minimum extent required by applicable law.
13. Indemnification
13.1 User Indemnification Obligation
You agree to defend, indemnify, and hold harmless the Developer and his affiliates, agents, successors, and assigns from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees and court costs) arising out of or relating to:
- Your access to or use of the Application;
- Your violation of any provision of these Terms;
- Your violation of any applicable law or regulation;
- Your infringement of any Intellectual Property Rights or other rights of any third party;
- Any content, photographs, or materials you process using the Application;
- Any misrepresentation made by you in connection with these Terms.
13.2 Developer's Rights in Defense
The Developer reserves the right, at his own expense, to assume the exclusive defense and control of any matter for which you are required to indemnify the Developer. You agree to cooperate with the Developer's defense of such claims. You will not settle any matter without the prior written consent of the Developer.
14. Third-Party Components, Frameworks, and Licenses
14.1 Open-Weight Model License
The Gemma 4 model is made available by Google LLC under the Gemma Terms of Use and applicable open-weight model license published by Google. The Developer's use of the Gemma 4 model is subject to such license terms. Users of the Application benefit from the on-device integration of this model but are not direct licensees of Google with respect to the Gemma model through their use of PhotoLens.
14.2 LiteRT-LM Framework
The LiteRT-LM inference framework is developed by Google LLC and is used pursuant to its applicable open-source license. The Developer does not modify the core LiteRT-LM framework and integrates it as a runtime dependency.
14.3 Other Open-Source Components
The Application may incorporate additional open-source libraries and components governed by their respective licenses (including but not limited to the Apache 2.0 License, MIT License, or BSD License). The use of such components is subject to the terms of their respective licenses. Copies of applicable open-source license notices may be available within the Application's settings or documentation.
14.4 No Endorsement
The inclusion of Third-Party Components in the Application does not constitute an endorsement of those components, their developers, or their respective organizations by the Developer. Similarly, the Developer's use of the Gemma 4 model does not constitute an endorsement of PhotoLens by Google LLC.
14.5 Third-Party License Compliance
The Developer represents that, to the best of his knowledge, the Application's use of all Third-Party Components complies with their respective license terms. Users may not use the Application in any manner that would cause the Developer to be in violation of such third-party license terms.
15. Intellectual Property Rights of the Developer
15.1 Developer Ownership
The Application, including all of its source code, compiled binaries, user interface designs, visual elements, icons, graphics, text, documentation, and the selection and arrangement of all Application components (excluding Third-Party Components and User Content), is the exclusive Intellectual Property of the Developer and is protected by applicable copyright, trademark, trade secret, and other intellectual property laws.
15.2 No Assignment
Nothing in these Terms transfers or assigns any of the Developer's Intellectual Property Rights to you. You acquire no ownership interest in the Application by virtue of your use of it or your acceptance of these Terms.
15.3 Trademark
"PhotoLens" is a product name used by the Developer. Nothing in these Terms grants you any right to use this name, logo, or any other trademark or trade name of the Developer without prior written consent.

Copyright © 2026 Susant Swain. All rights reserved. Unauthorized reproduction, distribution, or modification of the Application or any of its components is strictly prohibited and may result in civil and criminal liability.
16. Updates, Modifications, and Discontinuation
16.1 Application Updates
The Developer may from time to time release updates, patches, or new versions of the Application through the Google Play Store or other authorized distribution channels. Such updates may modify, add, or remove features, change the AI Model, improve accessibility, or address software defects. By enabling automatic updates on your Device, or by manually installing updates, you agree that these Terms (as updated pursuant to Section 20) shall apply to all versions of the Application.
16.2 Feature Changes
The Developer reserves the right to modify, limit, or discontinue any feature or functionality of the Application at any time, with or without notice, including features related to AI description generation, accessibility, or gallery navigation. The Developer shall not be liable to you or any third party for any such modification, suspension, or discontinuation.
16.3 Discontinuation of the Application
The Developer reserves the right to discontinue the Application entirely at any time for any reason, including but not limited to changes in technology, changes in the availability of Third-Party Components, or business or personal decisions. In the event of discontinuation, the Developer will make reasonable efforts to provide advance notice where practicable.
16.4 No Obligation to Maintain
The Developer is under no obligation to provide maintenance, support, updates, or error corrections for the Application beyond what is voluntarily offered. Nothing in these Terms shall be construed to create any obligation on the part of the Developer to continue developing or publishing the Application.
17. Device Compatibility and System Requirements
17.1 User Responsibility for Compatibility
It is your responsibility to ensure that your Device meets the minimum technical requirements to install and run the Application. The Developer does not warrant that the Application will be compatible with all Android devices, operating system versions, or hardware configurations.
17.2 Minimum Requirements
The Application is intended for Android devices running a recent version of the Android operating system, with sufficient GPU or NPU hardware to support on-device inference using the LiteRT-LM framework. Devices with insufficient processing capability may experience degraded performance, extended processing times, or inability to run the AI features of the Application.
17.3 Operating System Updates
Updates to the Android operating system, changes to the Android permissions model, or changes to the behavior of the Android TalkBack screen reader may affect the functionality or accessibility of the Application. The Developer will make reasonable efforts to maintain compatibility with current Android releases but cannot guarantee immediate compatibility with all future OS updates.
17.4 Storage Requirements
The Application, together with the Gemma 4 model weights required for on-device inference, may require substantial storage space on the User's Device. You are responsible for ensuring adequate available storage on your Device.
18. Governing Law and Dispute Resolution
18.1 Governing Law
These Terms and any dispute or claim arising out of or in connection with them or their subject matter shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles.
18.2 Informal Resolution
In the event of any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Application, you agree to first attempt to resolve the matter informally by contacting the Developer at info@susantswain.com. The Developer will make reasonable efforts to address your concerns within a reasonable period of time.
18.3 Jurisdiction
If informal resolution is unsuccessful, any legal action or proceeding arising out of or relating to these Terms shall be brought exclusively in the competent courts located in Bhubaneswar, Odisha, India. You hereby irrevocably consent to the personal jurisdiction and venue of such courts.
18.4 Class Action Waiver
To the fullest extent permitted by applicable law, you waive any right to participate as a plaintiff or class member in any purported class action, collective action, or representative action proceeding against the Developer with respect to any claim or dispute arising under these Terms or your use of the Application.
18.5 Limitation on Claims
Any claim arising out of or relating to these Terms or the Application must be filed within one (1) year after the cause of action arose. Claims filed after this period shall be permanently barred.
19. Severability and Entire Agreement
19.1 Severability
If any provision of these Terms is held by a court of competent jurisdiction to be invalid, illegal, or unenforceable for any reason, such provision shall be severed from these Terms, and the remaining provisions shall continue in full force and effect to the maximum extent possible, provided that the core commercial intent of these Terms is not fundamentally undermined.
19.2 Waiver
The failure of the Developer to enforce any right or provision of these Terms at any time shall not be construed as a waiver of that right or provision, nor shall it preclude the Developer from enforcing that right or provision in the future.
19.3 Entire Agreement
These Terms, together with any other policies, notices, or guidelines referenced herein or separately published by the Developer in connection with the Application, constitute the entire agreement between you and the Developer with respect to the Application and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, whether written or oral, regarding the Application.
19.4 No Third-Party Beneficiaries
These Terms do not create any third-party beneficiary rights. No person or entity other than you and the Developer shall have any right to enforce any provision of these Terms.
19.5 Language
These Terms are written in the English language. In the event of any inconsistency between an English version of these Terms and any translated version, the English version shall prevail.
20. Changes to These Terms
20.1 Right to Amend
The Developer reserves the right to modify, amend, or update these Terms at any time at his sole discretion. Changes may be made in response to new legal requirements, updates to the Application's functionality, changes in third-party services, or any other reason the Developer deems appropriate.
20.2 Notification of Changes
When material changes are made to these Terms, the Developer will notify users through a notice within the Application, an update to the "Last Updated" date at the top of this document, or through any other reasonable means of communication. It is your responsibility to periodically review these Terms.
20.3 Effect of Continued Use
Your continued use of the Application after the effective date of any changes to these Terms constitutes your binding acceptance of those changes. If you do not agree to the modified Terms, you must discontinue your use of the Application and uninstall it from your Device.
